01Acceptance of these terms條款接受
These Terms of Service ("Terms") govern your access to and use of bkpdrive, including the web app, progressive web app, command-line interface ("CLI"), application programming interface ("API"), and related sites and services (together, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.本服務條款（「條款」）規範你對 bkpdrive 的存取與使用，包括網頁應用程式、漸進式網頁應用程式（PWA）、命令列工具（CLI）、應用程式介面（API）及相關網站與服務（合稱「本服務」）。當你建立帳號、登入或以其他方式使用本服務，即表示你同意本條款與我們的隱私權政策。若你不同意，請勿使用本服務。
02Eligibility使用資格
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.你必須年滿 13 歲（或你所在國家法定數位同意年齡，以較高者為準），並具備締結有效契約的能力，方可使用本服務。若你代表組織使用本服務，即表示你已獲授權代表該組織接受本條款。
03The service服務內容
bkpdrive provides cloud file storage. Each account currently includes a free storage allowance (presently 100 GB) and per-file size limits. Allowances, limits, and features may change over time. Beyond the free allowance we offer paid capacity plans (see Pricing and §10); we may also introduce advertising (see §11) or other features, and we may add, modify, limit, suspend, or discontinue any part of the Service at any time.bkpdrive 提供雲端檔案儲存。目前每個帳號包含免費儲存額度（現為 100 GB）與單檔大小上限。額度、限制與功能可能隨時間調整。在免費額度之外，我們提供付費的容量方案（見價格頁與 §10）；我們也可能推出廣告（見 §11）或其他功能，並可能隨時新增、修改、限制、暫停或終止本服務的任何部分。
You can store any file type on bkpdrive. Every file counts toward your storage allowance and can be downloaded at any time. Downloads are unlimited and provided free of charge on every plan.你可以在 bkpdrive 儲存任何類型的檔案。每個檔案都計入你的儲存額度，且隨時可以下載。所有方案的下載皆為無限且免費。
Teams. Capacity bought on a team plan is credited to your team capacity pool, from which you allocate it to teams you create, in 100 GB steps. It is not personal storage: it never increases your own account's allowance, and it cannot be gifted to another account (capacity from the personal plans can). You may reclaim capacity from a team at any time up to the space that team is not using, and deleting an emptied team returns its capacity to your pool. A team holds up to 10 members at no per-seat charge; every member can read, upload and delete any file in that team, and files belong to the team rather than to the member who uploaded them. 04Your account你的帳號
You sign in with a Google account. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials and personal access tokens. You agree to provide accurate information and to notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms, that are used unlawfully, or where required by law; a suspended account cannot sign in or access its files until reinstated.你以 Google 帳號登入。你須對帳號下發生的一切活動負責，並妥善保管你的登入憑證與個人存取 Token。你同意提供正確的資訊，並在發現任何未經授權的使用時通知我們。對於違反本條款、遭不法使用或依法必須處理的帳號，我們得暫停或終止；被停權的帳號在恢復前無法登入或存取其檔案。
05API & access tokensAPI 與存取 Token
You may access the Service programmatically using the CLI or API with a personal access token. A token acts on your behalf and carries your permissions — keep it secret, and revoke it if it is lost or exposed. You are responsible for all actions taken with your tokens. You agree to use the API in a manner that does not harm or unreasonably burden the Service, and to respect any rate limits or technical restrictions we apply. We may revoke tokens or restrict API access to protect the Service.你可以使用 CLI 或 API 搭配個人存取 Token，以程式方式存取本服務。Token 代表你本人行事並具有與你相同的權限，請妥善保密；若遺失或外洩，請立即撤銷。你須對以你的 Token 執行的一切操作負責。你同意以不損害、不過度加重本服務負擔的方式使用 API，並遵守我們設定的速率限制或技術限制。為保護本服務，我們得撤銷 Token 或限制 API 存取。
06Acceptable use合理使用
You agree not to use the Service to, and not to help anyone else:你同意不使用本服務從事下列行為，亦不協助他人從事：
- store, share, or transmit content that is illegal, infringes intellectual-property or privacy rights, or that you do not have the right to store;儲存、分享或傳輸違法、侵害智慧財產權或隱私權、或你無權儲存的內容；
- distribute malware or content designed to harm users, devices, or the Service;散布惡意軟體，或旨在傷害使用者、裝置或本服務的內容；
- store or distribute sexual content involving minors, or content that promotes violence, harassment, or unlawful activity;儲存或散布涉及未成年人的性內容，或宣揚暴力、騷擾或不法活動的內容；

To report illegal content on the Service (including child sexual exploitation material), email [email protected]. 07Your content & licence你的內容與授權
You retain all ownership rights in the files, folders, names, and data you upload ("Your Content"). To operate the Service, you grant bkpdrive a limited, non-exclusive, worldwide, royalty-free licence to host, store, back up, transmit, encode, transform (for example, to prepare your files for storage and return them on download), display back to you, and otherwise process Your Content solely to provide, secure, and maintain the Service for you. You represent that you own or have the necessary rights to Your Content and that it does not violate these Terms or applicable law. You are solely responsible for Your Content.你聲明你擁有你的內容或已取得必要權利，且其不違反本條款或適用法律。你須對你的內容自行負責。
08Copyright & takedowns著作權與下架
We respect intellectual-property rights and expect you to do the same. If you believe content stored on the Service infringes your copyright, send a notice to [email protected] with: identification of the work; the location (e.g. a link or enough detail to find it); your contact information; a statement that you have a good-faith belief the use is unauthorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them. We may remove or disable access to allegedly infringing content and will terminate, in appropriate cases, the accounts of repeat infringers.我們尊重智慧財產權，也期待你同樣尊重。若你認為儲存於本服務的內容侵害你的著作權，請寄送通知至 [email protected]，並附上：著作的說明；內容所在位置（例如連結，或足以找到它的資訊）；你的聯絡方式；你善意相信該使用未經授權的聲明；以及願負偽證責任、聲明通知內容屬實且你為權利人或獲授權代理人的陳述。我們得移除或停用被指侵權的內容，並於適當情形終止累犯者的帳號。
09Rewards & referrals獎勵與推薦
We may offer ways to earn additional storage — for example, by referring others who sign up and use the Service. Reward amounts, conditions, and the program itself may change or end at any time. Rewards have no cash value and are not transferable. Storage earned through fraud, automation, fake or self-referrals, or other abuse may be withheld or reversed, and we may suspend accounts engaged in such activity.我們可能提供賺取額外儲存空間的方式，例如推薦他人註冊並使用本服務。獎勵額度、條件與計畫本身可能隨時變更或終止。獎勵無現金價值且不可轉讓。以詐欺、自動化、虛假或自我推薦等濫用方式取得的空間，我們得不予發放或收回，並得停權從事該等行為的帳號。
10Purchases & refunds購買與退費
Some parts of the Service can be purchased — for example, one-time lifetime storage capacity. Prices are shown at checkout and, unless stated otherwise there, are in New Taiwan Dollars (TWD) and include applicable taxes. Payments are processed by our payment providers; we do not store your card details. Where required by law, a Taiwan uniform invoice (統一發票) is issued for your purchase.本服務的部分內容可供購買，例如一次性的終身儲存容量。價格以結帳頁顯示為準；除該頁另有標示外，均以新臺幣（TWD）計價並含應付稅額。付款由我們的金流服務商處理；我們不儲存你的卡片資訊。依法律要求，你的購買將開立統一發票。
"Lifetime" means the operating life of the Service: a lifetime purchase stays effective for as long as the Service operates, with no further charges. If the Service is discontinued, we will announce it in advance (see §15) and keep downloads open so you can retrieve your files.「終身」指本服務的營運期間：終身方案於本服務營運期間持續有效，不再收取任何費用。若本服務終止營運，我們將提前公告（見第 15 條），並保留下載管道讓你取回檔案。
30-day money-back guarantee. If you are not satisfied with a purchase for any reason, contact us at [email protected] within 30 days of payment and we will refund it in full — no questions asked. Refunds are processed within 14 business days of your request. When a purchase is refunded, its storage capacity is removed from your account. If your stored files exceed the capacity that would remain after the refund, we will ask you to first move the excess files to your trash: files in the trash do not count toward your storage and remain downloadable from the trash at any time, but restoring them is subject to your remaining capacity. Refunding a team purchase. The same 30-day guarantee applies, with one additional step: the capacity has to be back in your team capacity pool before the refund can be processed. Reclaim it from each team first; if a team still holds files, move them to that team's trash before reclaiming (trashed files stay downloadable). If you no longer need a team at all, emptying and deleting it returns its whole capacity to the pool.團隊購買的退費。同樣適用 30 天保證，但多一個步驟：容量必須先回到你的團隊容量池，才能辦理退費。請先從各團隊收回容量；若團隊中仍有檔案，請先把檔案移入該團隊的垃圾桶再收回（垃圾桶內的檔案仍可下載）。若你已不需要某個團隊，將它清空後刪除，其容量會全額回到池中。
Gifted capacity is non-refundable. Once any capacity from a purchase has been gifted to another account and the gift has been accepted, that purchase is no longer eligible for a refund — accepted gifts cannot be reclaimed from the recipient. A pending gift that has not been accepted yet can be cancelled first, after which the purchase remains refundable. We may also decline refund requests that form a repeated purchase-and-refund pattern on the same account.已轉贈的容量不可退費。一筆購買的容量只要有任何部分已轉贈其他帳號且獲對方接受，該筆購買即不再適用退費；已被接受的贈與無法自受贈人處收回。尚未被接受的轉贈可以先取消，取消後該筆購買仍可退費。對於同一帳號重複「購買後退費」的模式，我們亦得婉拒退費申請。
Refunds go back to the original payment method where possible; for payment methods that cannot be reversed directly, we will arrange a bank transfer with you. This guarantee is in addition to, and does not limit, any rights you have under Taiwan's Consumer Protection Act or other applicable law.退款將儘可能退回原付款方式；無法直接退回的付款方式，我們會與你另行約定匯款。本保證是在你依台灣消費者保護法或其他適用法律享有之權利以外附加提供，並不限制該等權利。
11Advertising廣告
bkpdrive includes a free allowance, and we may show advertising within the Service to support it. If we do, advertising is applied to accounts generally; we do not currently offer an "ad-free" purchase. We do not sell your personal information, and any advertising will be handled as described in our Privacy Policy.bkpdrive 包含免費額度，我們可能在本服務中顯示廣告以支持營運。若顯示廣告，將一體適用於所有帳號；我們目前不提供「去廣告」的購買選項。我們不販售你的個人資訊，任何廣告都將依我們的隱私權政策處理。
12No warranty不提供擔保
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or that the Service will be uninterrupted, secure, or that data will be preserved or recoverable.本服務係依「現狀」及「現有」基礎提供，不附任何形式之擔保，無論明示、默示或法定，包括適售性、特定目的適用性、不侵權、可用性、正確性之擔保，以及本服務不中斷、安全、資料必然保存或可回復之擔保。
Keep a copy of the irreplaceable. Keeping your files safe is what bkpdrive is built for, and we work hard at it every day. Still, no online service can promise that files are never lost or corrupted — so, as with any cloud service, we recommend keeping your own copy of files you truly cannot afford to lose. To the extent permitted by law, we are not responsible for loss of, corruption of, or inability to access Your Content.無可取代的檔案請自留備份。把你的檔案保存好是 bkpdrive 的存在目的，我們每天都為此努力。儘管如此，沒有任何線上服務能保證檔案絕不遺失或損壞；如同任何雲端服務，對於你確實無法承受遺失的檔案，建議自行保留一份備份。在法律允許的範圍內，我們對你的內容之遺失、毀損或無法存取不負責任。
13Limitation of liability責任限制
To the maximum extent permitted by law, bkpdrive and its operators, owners, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim (which, for free use, is zero) or USD 50. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.在法律允許的最大範圍內，bkpdrive 及其經營者、所有人與供應商，對因你使用（或無法使用）本服務所生或相關的任何間接、附隨、特別、衍生、懲戒性或懲罰性損害，或任何資料、利潤、營收、商譽或業務之損失，均不負責任，即使我們已被告知該可能性。於責任無法排除之情形，我們的總計責任上限為：你於引起請求之事件前 12 個月內，就本服務支付予我們之金額（免費使用為零），或美金 50 元，以較高者為準。部分法域不允許特定排除，故上述部分可能不適用於你。
14Indemnification補償
You agree to indemnify and hold harmless bkpdrive and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.因你的內容、你對本服務的使用，或你違反本條款、任何法律或第三方權利，致 bkpdrive 及其經營者遭受任何請求、損害、責任與費用（包括合理律師費）者，你同意予以補償並使其免受損害。
15Termination終止
You may stop using the Service and delete your account at any time; please export anything you want to keep first. We may suspend or terminate your access if you violate these Terms, if necessary to protect the Service or other users, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends and Your Content may be deleted. Sections that by their nature should survive termination (including content licence for residual backups, disclaimers, limitation of liability, indemnification, and governing law) will survive.你隨時可以停止使用本服務並刪除帳號；請先匯出你想保留的內容。若你違反本條款、為保護本服務或其他使用者所必要、法律有所要求，或本服務終止營運，我們得暫停或終止你的存取。終止後，你使用本服務的權利即告結束，你的內容可能被刪除。依其性質應於終止後存續的條款（包括為殘存備份之內容授權、免責聲明、責任限制、補償與準據法）將繼續有效。

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms. 17Governing law & disputes準據法與爭議
These Terms are governed by the laws of Taiwan (R.O.C.), without regard to conflict-of-law rules. You agree that the competent courts located in Taiwan will have jurisdiction over any dispute, unless mandatory consumer-protection law in your place of residence provides otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have.本條款以台灣（中華民國）法律為準據法，不適用其法律衝突規則。你同意任何爭議由台灣有管轄權之法院管轄；惟你居住地之強制性消費者保護法律另有規定者，從其規定。本條款不限制你依法享有之不可拋棄權利。
18General一般條款
These Terms and the Privacy Policy are the entire agreement between you and bkpdrive regarding the Service and supersede prior agreements. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries.本條款與隱私權政策構成你與 bkpdrive 就本服務之完整合意，並取代先前之約定。任一條款被認定無法執行時，其餘條款仍屬有效。我們未行使任一條款之權利，不構成拋棄。未經我們同意，你不得轉讓本條款；我們得將本條款轉讓予關係企業，或因合併、收購或資產出售而轉讓。本條款無第三方受益人。
