Our commitments — in plain language. The sections below are the formal terms that protect a free service. Here is what we promise you, simply:
- We don't sell your files, and we never use the contents of your files to target advertising.
- You can export your data and delete your account at any time.
- If we ever have to discontinue the Service, we'll aim to give you reasonable advance notice so you can retrieve your files.
- Think of bkpdrive as a free extra copy of your files — please keep your own originals too.
01Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of bkpdrive, including the web app, progressive web app, command-line interface ("CLI"), application programming interface ("API"), and related sites and services (together, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
02Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.
03The service
bkpdrive provides cloud file storage. Each account currently includes a free storage allowance (presently 100 GB) and per-file size limits. Allowances, limits, and features may change over time. The Service is provided free of charge today; we may introduce paid plans, advertising (see §10), or other features, and we may add, modify, limit, suspend, or discontinue any part of the Service at any time.
You can store any file type on bkpdrive. Every file counts toward your storage allowance and can be downloaded at any time. Downloads are unlimited and provided free of charge on every plan.
04Your account
You sign in with a Google account. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials and personal access tokens. You agree to provide accurate information and to notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms, that are used unlawfully, or where required by law; a suspended account cannot sign in or access its files until reinstated.
05API & access tokens
You may access the Service programmatically using the CLI or API with a personal access token. A token acts on your behalf and carries your permissions — keep it secret, and revoke it if it is lost or exposed. You are responsible for all actions taken with your tokens. You agree to use the API in a manner that does not harm or unreasonably burden the Service, and to respect any rate limits or technical restrictions we apply. We may revoke tokens or restrict API access to protect the Service.
06Acceptable use
You agree not to use the Service to, and not to help anyone else:
- store, share, or transmit content that is illegal, infringes intellectual-property or privacy rights, or that you do not have the right to store;
- distribute malware or content designed to harm users, devices, or the Service;
- store or distribute sexual content involving minors, or content that promotes violence, harassment, or unlawful activity;
- attempt to gain unauthorized access to the Service, other accounts, or our systems, or probe, scan, or test their security without permission;
- use the Service to operate a public file-distribution or content-delivery service, to circumvent storage or rate limits, or to resell the Service;
- scrape, overload, disrupt, or otherwise interfere with the Service or with other users' use of it.
We may, but are not obligated to, review content or activity and remove content or restrict accounts that we reasonably believe violate these Terms or the law.
07Your content & licence
You retain all ownership rights in the files, folders, names, and data you upload ("Your Content"). To operate the Service, you grant bkpdrive a limited, non-exclusive, worldwide, royalty-free licence to host, store, back up, transmit, encode, transform (for example, to prepare your files for storage and return them on download), display back to you, and otherwise process Your Content solely to provide, secure, and maintain the Service for you. This licence ends when you delete Your Content or close your account, except for content already removed from active systems but retained briefly in backups, and except as required to comply with the law.
You represent that you own or have the necessary rights to Your Content and that it does not violate these Terms or applicable law. You are solely responsible for Your Content.
08Copyright & takedowns
We respect intellectual-property rights and expect you to do the same. If you believe content stored on the Service infringes your copyright, send a notice to [email protected] with: identification of the work; the location (e.g. a link or enough detail to find it); your contact information; a statement that you have a good-faith belief the use is unauthorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them. We may remove or disable access to allegedly infringing content and will terminate, in appropriate cases, the accounts of repeat infringers.
09Rewards & referrals
We may offer ways to earn additional storage — for example, by referring others who sign up and use the Service. Reward amounts, conditions, and the program itself may change or end at any time. Rewards have no cash value and are not transferable. Storage earned through fraud, automation, fake or self-referrals, or other abuse may be withheld or reversed, and we may suspend accounts engaged in such activity.
10Advertising
bkpdrive is free, and we may show advertising within the Service to support it. If we do, advertising is applied to accounts generally; we do not currently offer an "ad-free" purchase. We do not sell your personal information, and any advertising will be handled as described in our Privacy Policy.
11No warranty & your backups
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or that the Service will be uninterrupted, secure, or that data will be preserved or recoverable.
Keep your originals. Think of bkpdrive as a free extra copy of your files — not your only backup. We work hard to keep your data safe, but no online service can promise that files are never lost or corrupted, so please keep independent copies of anything important to you. To the extent permitted by law, we are not responsible for loss of, corruption of, or inability to access Your Content.
12Limitation of liability
To the maximum extent permitted by law, bkpdrive and its operators, owners, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim (which, for free use, is zero) or USD 50. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.
13Indemnification
You agree to indemnify and hold harmless bkpdrive and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
14Termination
You may stop using the Service and delete your account at any time; please export anything you want to keep first. We may suspend or terminate your access if you violate these Terms, if necessary to protect the Service or other users, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends and Your Content may be deleted. Sections that by their nature should survive termination (including content licence for residual backups, disclaimers, limitation of liability, indemnification, and governing law) will survive.
15Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms. If you do not agree, stop using the Service and delete your account.
16Governing law & disputes
These Terms are governed by the laws of Taiwan (R.O.C.), without regard to conflict-of-law rules. You agree that the competent courts located in Taiwan will have jurisdiction over any dispute, unless mandatory consumer-protection law in your place of residence provides otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have.
17General
These Terms and the Privacy Policy are the entire agreement between you and bkpdrive regarding the Service and supersede prior agreements. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries.
