Our commitments — in plain language. The sections below are the formal terms that protect a small, independent service. Here is what we promise you, simply:
- We don't sell your files, and we never use the contents of your files to target advertising.
- You can export your data and delete your account at any time.
- Every purchase comes with a 30-day, no-questions-asked full refund.
- If we ever have to discontinue the Service, we'll aim to give you reasonable advance notice so you can retrieve your files.
- Keeping your files safe is the whole point of bkpdrive — and as with any cloud service, we still recommend keeping your own copy of anything irreplaceable.
01Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of bkpdrive, including the web app, progressive web app, command-line interface ("CLI"), application programming interface ("API"), and related sites and services (together, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
02Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.
03The service
bkpdrive provides cloud file storage. Each account currently includes a free storage allowance (presently 100 GB) and per-file size limits. Allowances, limits, and features may change over time. Beyond the free allowance we offer paid capacity plans (see Pricing and §10); we may also introduce advertising (see §11) or other features, and we may add, modify, limit, suspend, or discontinue any part of the Service at any time.
You can store any file type on bkpdrive. Your files, including files in the trash, count toward your storage allowance and can be downloaded at any time. Downloads are unlimited and provided free of charge on every plan. Files in the archive are kept and do not count toward your allowance, but they currently cannot be downloaded or restored; we may offer a paid way to retrieve them in the future.
Trash and archive. Deleting a file or folder moves it to the trash. Items in the trash count toward your storage and can still be downloaded or restored. Once 30 days have passed since deletion, they move to the archive automatically; you can also move them there sooner. Items in the archive do not count toward your storage and are not deleted automatically, but they currently cannot be downloaded, restored, or moved back to the trash. You can permanently delete items in the trash or the archive at any time. Permanent deletion cannot be undone: the items are removed from your account and can no longer be retrieved, even by contacting us. Teams work the same way, with each member acting within their access level, and a team's trash counts toward that team's capacity.
Teams. Capacity bought on a team plan is credited to your team capacity pool, from which you allocate it to teams you create, in 100 GB steps. It is not personal storage: it never increases your own account's allowance, and it cannot be gifted to another account (capacity from the personal plans can). You may reclaim capacity from a team at any time up to the space that team is not using, and deleting an emptied team returns its capacity to your pool. A team holds up to 10 members at no per-seat charge. Members can see, download and upload files in that team and move them to the trash, except that a member set to view and download only can only view and download files, and a restricted folder is visible only to the team owner and the members on its list, and each item follows the list of the nearest restricted folder it is in. The team owner can see every file in the team, including every restricted folder, and only the team owner can archive or permanently delete files. Members of a team can see each other's display names, email addresses and profile pictures. Files belong to the team rather than to the member who uploaded them. Removing a member does not transfer that member's uploads out of the team.
04Your account
You sign in with a Google account or with a verification code sent to your email address. You are responsible for all activity that occurs under your account and for keeping access to your email address and your signed-in devices secure. You agree to provide accurate information and to notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms, that are used unlawfully, or where required by law; a suspended account cannot sign in or access its files until reinstated.
05CLI & API access
You may access the Service programmatically using our CLI or API. Signing in on the CLI stores a credential on that device which acts on your behalf and carries your permissions, so treat the device as you would a signed-in browser. You are responsible for all actions taken through your signed-in devices. You agree to use the API in a manner that does not harm or unreasonably burden the Service, and to respect any rate limits or technical restrictions we apply. We may restrict API access to protect the Service.
06Acceptable use
You agree not to use the Service to, and not to help anyone else:
- store, share, or transmit content that is illegal, infringes intellectual-property or privacy rights, or that you do not have the right to store;
- distribute malware or content designed to harm users, devices, or the Service;
- store or distribute sexual content involving minors, or content that promotes violence, harassment, or unlawful activity;
- attempt to gain unauthorized access to the Service, other accounts, or our systems, or probe, scan, or test their security without permission;
- use the Service to operate a public file-distribution or content-delivery service, to circumvent storage or rate limits, or to resell the Service;
- scrape, overload, disrupt, or otherwise interfere with the Service or with other users' use of it.
We may, but are not obligated to, review content or activity and remove content or restrict accounts that we reasonably believe violate these Terms or the law.
To report illegal content on the Service (including child sexual exploitation material), email [email protected]. We act on reports as required by law: removal, notification of the authorities, and preservation of the necessary records.
07Your content & licence
You retain all ownership rights in the files, folders, names, and data you upload ("Your Content"). To operate the Service, you grant bkpdrive a limited, non-exclusive, worldwide, royalty-free licence to host, store, back up, transmit, encode, transform (for example, to prepare your files for storage and return them on download), display back to you, and otherwise process Your Content solely to provide, secure, and maintain the Service for you. This licence ends when you delete Your Content or close your account, except for content already removed from active systems but retained briefly in backups, and except as required to comply with the law.
You represent that you own or have the necessary rights to Your Content and that it does not violate these Terms or applicable law. You are solely responsible for Your Content.
08Copyright & takedowns
We respect intellectual-property rights and expect you to do the same. If you believe content stored on the Service infringes your copyright, send a notice to [email protected] with: identification of the work; the location (e.g. a link or enough detail to find it); your contact information; a statement that you have a good-faith belief the use is unauthorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them. We may remove or disable access to allegedly infringing content and will terminate, in appropriate cases, the accounts of repeat infringers.
09Rewards & referrals
We may offer ways to earn additional storage — for example, by referring others who sign up and use the Service. Reward amounts, conditions, and the program itself may change or end at any time. Rewards have no cash value and are not transferable. Storage earned through fraud, automation, fake or self-referrals, or other abuse may be withheld or reversed, and we may suspend accounts engaged in such activity.
Sponsored content. If we offer it, you may be able to earn a free upload allowance by choosing to watch sponsored content. A free upload allowance is valid only on the day it is earned (Taipei time) and expires at midnight if unused. Files, or the parts of files, uploaded with it do not count toward your storage capacity; deleting them does not free capacity for other files. A free upload allowance cannot be transferred, gifted, refunded, or exchanged for cash, and it does not apply to team spaces. We may withhold it, or make files uploaded with it count toward your capacity, if it was obtained through automation, multiple accounts, or other abuse; if that leaves you using more than your capacity, new uploads are blocked until you free up space, but your files are not deleted. We may change, pause, or end the offer, including its amounts and conditions, at any time; an unused allowance has no cash value and no compensation is given.
10Purchases & refunds
Some parts of the Service can be purchased — for example, one-time lifetime storage capacity. Prices are shown at checkout and, unless stated otherwise there, are in New Taiwan Dollars (TWD) and include applicable taxes. Payments are processed by our payment providers; we do not store your card details. Where required by law, a Taiwan uniform invoice (統一發票) is issued for your purchase.
"Lifetime" means the operating life of the Service: a lifetime purchase stays effective for as long as the Service operates, with no further charges. If the Service is discontinued, we will announce it in advance (see §15) and keep downloads open so you can retrieve your files.
30-day money-back guarantee. If you are not satisfied with a purchase for any reason, contact us at [email protected] within 30 days of payment and we will refund it in full, no questions asked. Refunds are processed within 14 business days of your request. When a purchase is refunded, its storage capacity is removed from your account. If your files take up more than the capacity that would remain after the refund, we will ask you to first free up the difference by moving files to the archive or deleting them permanently. Files in the trash still count toward your storage, so moving files to the trash is not enough. Archived files do not count toward your storage and are kept, but they currently cannot be downloaded or restored, so download anything you need before archiving it. Your files are never destroyed by a refund.
Refunding a team purchase. The same 30-day guarantee applies, with one additional step: the capacity has to be back in your team capacity pool before the refund can be processed. Reclaim it from each team first; if a team's files, including those in its trash, are using that space, move them to that team's archive or delete them permanently before reclaiming. Archived files currently cannot be downloaded or restored, so download anything you need first. If you no longer need a team at all, deleting it returns its whole capacity to the pool; before you delete it, remove its files and empty its trash (files in its archive do not need to be removed).
Gifted capacity is non-refundable. Once any capacity from a purchase has been gifted to another account and the gift has been accepted, that purchase is no longer eligible for a refund — accepted gifts cannot be reclaimed from the recipient. A pending gift that has not been accepted yet can be cancelled first, after which the purchase remains refundable. We may also decline refund requests that form a repeated purchase-and-refund pattern on the same account.
Refunds go back to the original payment method where possible; for payment methods that cannot be reversed directly, we will arrange a bank transfer with you. This guarantee is in addition to, and does not limit, any rights you have under Taiwan's Consumer Protection Act or other applicable law.
11Advertising
bkpdrive includes a free allowance, and we may show advertising within the Service to support it, including short sponsored content shown when you return to the app. Accounts that have purchased a plan that has not been refunded do not currently see the sponsored content shown on return, and neither do members while they are working in a team space. We do not sell your personal information, and any advertising will be handled as described in our Privacy Policy. Sponsored content that you choose to watch in exchange for a free upload allowance is covered in §9.
12No warranty
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or that the Service will be uninterrupted, secure, or that data will be preserved or recoverable.
Keep a copy of the irreplaceable. Keeping your files safe is what bkpdrive is built for, and we work hard at it every day. Still, no online service can promise that files are never lost or corrupted — so, as with any cloud service, we recommend keeping your own copy of files you truly cannot afford to lose. To the extent permitted by law, we are not responsible for loss of, corruption of, or inability to access Your Content.
13Limitation of liability
To the maximum extent permitted by law, bkpdrive and its operators, owners, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim (which, for free use, is zero) or USD 50. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.
14Indemnification
You agree to indemnify and hold harmless bkpdrive and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
15Termination
You may stop using the Service and delete your account at any time; please export anything you want to keep first. We may suspend or terminate your access if you violate these Terms, if necessary to protect the Service or other users, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends and Your Content may be deleted. Sections that by their nature should survive termination (including content licence for residual backups, disclaimers, limitation of liability, indemnification, and governing law) will survive.
16Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms. If you do not agree, stop using the Service and delete your account.
17Governing law & disputes
These Terms are governed by the laws of Taiwan (R.O.C.), without regard to conflict-of-law rules. You agree that the competent courts located in Taiwan will have jurisdiction over any dispute, unless mandatory consumer-protection law in your place of residence provides otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have.
18General
These Terms and the Privacy Policy are the entire agreement between you and bkpdrive regarding the Service and supersede prior agreements. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries.
These Terms are provided in Chinese and English; both language versions are equally authentic.
